The Mental Health Parity and Addiction Equity Act (MHPAEA) of 2008 applies to large group plans and requires cost sharing to be the same for mental health and substance abuse treatments as for other types of health care. It does not, however, require employers or health plans to offer mental health or substance abuse benefits. Beginning in 2014, as part of the essential health benefits provisions, the Affordable Care Act requires that health insurance plans offered in the individual market and most small group plans include coverage for mental health and substance abuse and comply with parity laws.
